What these terms cover

These terms apply to this website and to any rental arranged through it. The rental itself is also governed by the agreement you sign at handover; where the two differ, the signed agreement wins.

What we provide

MARBIORA manages a fleet of privately owned cars and rents them to you with delivery and collection included. The rentals run on Exclusive Car Rent, the platform behind our fleet.

Booking and confirmation

A request through the website, WhatsApp or the phone is not a reservation. Nothing is held for you until we confirm availability, the total price and the delivery time in writing.

We may decline a booking, for example when the driver does not meet the requirements or the car is no longer available.

Prices and what is included

The price you are given before confirmation is the price of the rental. Delivery, collection and comprehensive insurance are included in it.

Charges that depend on what happens during the rental, such as additional kilometres or refuelling, are set out in your rental agreement before you sign it.

Payment and insurance

No payment is taken through this website. The price of the rental, how and when it is paid, the security deposit and the insurance excess that applies if the car is damaged are set out in your rental agreement and confirmed with you before the rental begins.

The deposit is held against the card of the main driver and released after the car comes back and has been checked.

Who may drive

Only drivers named in the rental agreement may drive the car. Each of them must meet the minimum age and licence requirements set out in that agreement and must present a valid licence and identity document at handover.

Additional drivers can be added, but they must be named before delivery.

Using the car

While the car is with you, it may not be:

• Driven by anyone not named in the agreement.
• Used for racing, track days, driving courses or any competition.
• Sublet, hired out or used to carry passengers for payment.
• Taken outside Spain without arranging it with us in advance.
• Driven by anyone under the influence of alcohol, drugs or medication that affects driving.

The car comes to you full of fuel and is expected back the same way.

Damage, fines and loss

Tell us the same day if anything happens to the car. We handle the claim, the repair and the replacement arrangements.

Traffic fines and tolls incurred while the car is with you remain yours, together with the administrative cost of processing them.

Changes and cancellation

Dates can usually be moved, and we would rather move them than lose you. The notice periods and any charges are set out in your rental agreement.

If we cannot provide the car you booked, we offer an equivalent or better one, or return everything you have paid.

Our responsibility

We are responsible for delivering a car that is roadworthy, prepared and insured as agreed. We are not responsible for losses outside our control, such as weather, traffic or the actions of third parties.

Nothing in these terms limits your rights as a consumer under Spanish law.
